Terms and Conditions of Attendance and Participation At A Concierge Medicine Today, LLC EVENT

These are the terms (the “Agreement”) that govern your attendance at and/or participation in the Concierge Medicine Today, LLC. (CMT), CONCIERGE MEDICINE FORUM (CMF) (herein the “Event” or “CMF”). I CERTIFY THAT I HAVE READ THIS DOCUMENT, AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I AGREE TO IT OF MY OWN FREE WILL.

By registering for any Concierge Medicine Today, LLC., (CMT or CMF) Event you are agreeing to these terms, which form a legal contract between Concierge Medicine Today, LLC. (“CMT”), and the registered attendee and/or participant (“you”). If you are registering on behalf of another it is your responsibility to ensure that the person attending is aware of these terms and accepts them, and by completing the registration you are warranting that you have made the attendee aware of these terms and that they have accepted these terms.

Your Consent

By attending our event(s), using our affiliated or owned site(s) in any way, shape, form, completing a form, sponsoring, participating as a speaker, participating as an attendee, advertising, subscribing, purchasing, being a guest on a podcast, webinar, speaking at one of our virtual or live events, or participating in any way at a Concierge Medicine Today, LLC. affiliated products, brands or web sites, you consent to and agree to our online privacy policy, acceptance of use, Comprehensive Terms and Conditions, legal disclaimers, waivers, notices, updates to any and all terms and conditions as outlined below and understand the Agreement below supercedes any and all past agreements, terms of use, privacy policies, legal disclaimers, notices, waivers and the like. Thank you.

By using our Website(s), you agree to fully comply with and be bound by the following Agreement each time you use our Website. Acceptance of Agreement

This Agreement is between you and Concierge Medicine Today, LLC, and you understand that these Terms and Condition supercede any and all past Terms and Conditions and/or Agreements.

THIS AGREEMENT CONTAINS WARRANTY DISCLAIMERS AND OTHER PROVISIONS THAT LIMIT OUR LIABILITY TO YOU. PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY AND IN THEIR ENTIRETY, AS USING, ACCESSING, AND/OR BROWSING OUR WEBSITE CONSTITUTES ACCEPTANCE OF THESE TERMS AND CONDITIONS. IF YOU DO NOT AGREE TO BE BOUND TO EACH AND EVERY TERM AND CONDITION SET FORTH HEREIN, PLEASE EXIT OUR WEBSITE IMMEDIATELY AND DO NOT USE, ACCESS, AND/OR BROWSE IT FURTHER.

Except as otherwise noted, this Agreement constitutes the entire and only Agreement between you and Concierge Medicine Today, LLC and supersedes all other Agreements, representations, warranties, and understandings with respect to our Website, Services, and the subject matter contained herein. However, for you to use our Website and/or Services, you may also be required to agree to additional terms and conditions. Those additional terms and conditions will be incorporated into this Agreement unless otherwise stated.

1. Event admission

1.1. Admittance. Your registration entitles you to admittance to the Event. Any and all other costs associated with your attendance (including without limitation any travel and/or accommodation expenses) shall be borne solely by you and CMT shall have no liability whatsoever for such costs, risks or accidents.
1.2. Termination. You acknowledge that CMT reserves the right to request your removal from the Event if CMT, in its sole discretion, considers your presence and/or behavior to create a disruption or to hinder the Event and/or the enjoyment of the Event by other attendees or speakers.
1.3. Media. By attending the Event you acknowledge and agree to grant CMT the right at the Event to record, film, photograph or capture your likeness in any media now available and hereafter developed and to distribute, broadcast, use or otherwise globally to disseminate, in perpetuity, such media without any further approval from you or any payment to you. This grant to CMT includes, but is not limited to, the right to edit such media, the right to use the media alone or together with other information, and the right to allow others to use and/or disseminate the media.
1.4. Event Content. You acknowledge and agree that CMT, in its sole discretion, reserves the right to change any and all aspects of the Event, including but not limited to, the Event name, themes, content, program, speakers, performers, hosts, moderators, and time.

2. Fee(s)

2.1. Payment. The payment of the applicable fee(s) for the Event is due upon registration. If such payment is insufficient or declined for any reason CMT may refuse to admit you to the Event and shall have no liability in that regard.
2.2. Taxes. The fee(s) may be subject sales tax, value added tax, or any other taxes and duties which, if applicable, will be charged to you in addition to the fee(s).

3. Substitution and cancellation policy

CMF event ticket purchases are transferrable but non-refundable if you are unable to attend.

  • We do not apply discounts retroactively. Once you have registered, even if a promo code is found after you registered, your fees will not be adjusted downward based on any sponsorship, promo code, discount or any other reason.
  • Virtual tickets are only valid for one user. Registrants failing to attend the event will not be eligible for a refund.
  • If your payment is received in currency other than U.S. dollars, and you are due a refund, you will be responsible for any foreign exchange rate difference.
  • Concierge Medicine Today, LLC., does not and is not obligated to provide a credit voucher to registered attendee(s) who do not attend any virtual or live event for which they registered for. Therefore, Registrants failing to attend the event will not be eligible for a refund.
  • REGISTRATION FEE DEFINITION:
  • The fee includes the conference‚ all program materials‚ and designated continental breakfasts‚ lunches and refreshments.
  • Request For Change/Refund Request Form
  • Cancellations received via phone or email will not be accepted. You must submit in writing your Request for Change found here.
  • Current Cancellation and Refund Policy
  • Conference registration cancellation requests submitted on or before September 15, 2021 will be refunded, less a 50% processing fee or a $150 administrative fee per ticket, whichever is less.
  • Cancellations received on or before September 30, 2021 will be refunded, less a 75% processing fee or a $200 administrative fee per ticket, whichever is less.
  • No refunds or credits will be issued for conference registration cancellations received after September 30, 2021.
  • Additionally, in the case the registrant has completed the Request for Change Form found here, tickets purchased will be: 1) refunded and all ticket purchases minus a $150 administrative fee per ticket OR 50% of the total ticket purchases price will be refunded within 15 days of a cancellation; or, 2) Ticket purchaser fees will be Rolled Over to another event; or, 3) Fees will be redirected to other benefits; or, 4) Ticket Fees may be donated to the event organizer.
  • Redirecting Registration Fees Purchase and Rollover Options Available
  • Rollover Registration
    • If an event gets postponed, moved to a virtual platform or rescheduled to a future date, the tickets will automatically transfer to that future event date.
  • Credit Vouchers (Expire in 18mos)
    • Credit vouchers are valid for 18 months from date of issue. Credit vouchers are valid toward one (1) Concierge Medicine Today, LLC event of equal or lesser value. If the full amount of said voucher is not used at time of registration, any remaining balance is not applicable now or in the future. Once a credit voucher has been applied toward a future event, no further changes or edits will be allowed. In the event of cancellation on the attendees’ behalf, the credit voucher will no longer be valid and the money will not be refunded.
  • Redirecting Fees to Other Benefits
    • If an event gets postponed, moved to a virtual platform or rescheduled to a future date, the tickets may automatically transfer to our DocPreneur Leadership Academy Courses and/or Classes. We’ll let registrants use redirect their ticket fees on anything we have to offer within the DocPreneur Leadership Academy, whether that’s a membership extension, a Master Class, Course Registration, or another event. What we want to do is to be flexible with everyone and permit them to have a few different options. And if you still don’t want to do that and invest in these other ways, then refund any ticket purchase(s) minus a $150 administrative fee per ticket, will be refunded within 60 days of a cancellation.
  • MAKE A DONATION
    • It takes significant expenditures to cancel and/or run an event. Let us know that you’d like to donate your ticket fee to our operations and we will do so. Note, Concierge Medicine Today, LLC., is not a non-profit organization and you will not receive a tax deduction.
  • Concierge Medicine Today, LLC reserves the right to cancel any event it deems necessary and will not be responsible for airfare‚ hotel or any other expenses incurred by registrants.
  • Concierge Medicine Today, LLC’s financial liability/obligation to you is limited only to the conference registration fee in the event of a cancellation and does not include changes in program date‚ content‚ speakers and/or venue or any other expenses you may have personally or professionally incurred as a result of attending or participating in said live or virtual event.
  • By registering for this event you understand that *The opinions of Concierge Medicine Today, LLC’s speakers do not necessarily reflect those of the companies they represent, nor Concierge Medicine Today, and furthermore, hold harmless Concierge Medicine Today, LLC., its affiliated employees, representatives and/or companies or entities and any/all individuals liable for any reason.
  • Speakers and agenda are subject to change without notice. In the event of a speaker cancellation, significant effort to find a suitable replacement will be made. The content in Concierge Medicine Today, LLC slide presentations, including news, data, advertisements and other information, is provided by Concierge Medicine Today’s designated speakers and is designed for informational purposes for its attendees. It is NOT INTENDED for purposes of copy writing or redistribution to other outlets without the express written permission of Concierge Medicine Today, LLC’s designated speaking parties. Neither Concierge Medicine Today, LLC nor its content providers and/or speakers and attendees shall be liable for any errors, inaccuracies or delays in content, or for any actions taken in reliance thereon.
  • Force Majeure
  • No refund is required if the event is rescheduled due to an act of God or catastrophe and the ticket purchaser is given the right to use the ticket for the rescheduled event or to exchange the ticket for a comparable ticket to a similar event.
  • If the Concierge Medicine Today, LLC., (herein CMF) CONCIERGE MEDICINE FORUM is prevented from carrying out its obligations to the registrants to conduct its 2021 conference as a result of any issue beyond its control, or the conference cannot be conducted virtually because of availability of speakers, logistics, costs, software or issues with the hosting platform or due to Acts of God, strikes, labor disputes, government requisitions or restrictions or war or apparent act of war, terrorism, disaster, civil disorder, epidemic or pandemic, curtailment or restriction on transportation facilities or any other comparable calamity, casualty or condition making it impossible or impracticable to hold the 2021 conference or any part thereof (each of the foregoing, a “Force Majeure”) , CMF shall have the right to immediately terminate all or any portion of the 2021 conference without liability and shall be relieved of its obligations to all registrants. CMF reserves the sole right to determine if undelivered content can reasonably be delivered by alternative arrangements. If the 2021 CMF conference is terminated due to a Force Majeure occurrence before the first day of the conference, CMF will reschedule a similar all virtual event either through CMF or an affiliate organization and your registration fee will be applied to the rescheduled conference.

4. Privacy policy

4.2 Our Privacy Notice is considered part of this Agreement and is available on this website. You must review our Privacy Notice by clicking on https://conciergemedicinetoday.org/privacy-policy/. If you do not accept and agree to be bound by all the terms of this Agreement, including the https://conciergemedicinetoday.org/privacy-policy/ Privacy Notice, do not use this Website or our Services.

4.3 You permit Concierge Medicine Today, LLC., to share with sponsors, attendees and exhibitors your personal contact information, which may or may not be limited to: FULL NAME, Office Address, Office Name, Telephone Number and Email Address.

5. Intellectual property

5.1. All intellectual property rights in and to the Event, the Event content and all materials distributed at or in connection with the Event are owned by CMT and/or the Event sponsors or speakers presenting at the Event. You may not use or reproduce or allow anyone to use or reproduce any trademarks or other trade names appearing at the Event, in any Event content and/or in any materials distributed at or in connection with the Event for any reason without the prior written permission of CMT.
5.2. For the avoidance of doubt, nothing in this Agreement shall be deemed to vest in you any legal or beneficial right in or to any trade marks or other intellectual property rights owned or used under license by CMT or any of its affiliates or grant to you any right or license to any other intellectual property rights of CMT or its affiliates, all of which shall at all times remain the exclusive property of CMT and its affiliates.

5.3 Our Website may contain our service marks or trademarks as well as those of our affiliates or other companies in the form of words, graphics, and logos. Your use of our Website or Services does not constitute any right or license for you to use our service marks or trademarks without the prior written permission of Concierge Medicine Today, LLC.

5.4 Our Content, as found within our Website and Services, is protected under United States and foreign copyrights. The copying, redistribution, use, or publication by you of any such Content is strictly prohibited. Your use of our Website and Services does not grant you any ownership rights to our Content.

6. Warranties and limitation of liability

6.1. CMT gives no warranties in respect of any aspect of the Event or any materials related thereto or offered at the Event and, to the fullest extent possible under the laws governing this Agreement, disclaims all implied warranties, including but not limited to warranties of fitness for a particular purpose, accuracy, timeliness and merchantability. Neither CMT nor its affiliates can accept any responsibility or liability for reliance by you or any person on any aspect of the Event and/or any information provided at the Event.
6.2. Other than to the extent required as a matter of law: (i) neither CMT nor its affiliates shall be liable for any direct, indirect, special, incidental, or consequential costs, damages or losses arising directly or indirectly from the Event or other aspect related thereto or in connection with this Agreement.
6.3. The maximum aggregate liability of CMT for any claim in any way connected with therewith or this Agreement whether in contract, tort or otherwise (including any negligent act or omission) shall be limited to the amount paid by you to CMT under this Agreement to register to attend the Event. If you attended as a speaker or sponsor, or are affiliated with a speaker or sponsor, then no amount shall be paid to you under this Agreement.

6.4 CONCIERGE MEDICINE TODAY, LLC is not responsible or liable in any manner for any Content posted on our Website or in connection with our Services, whether posted or caused by Members of our Website, or by CONCIERGE MEDICINE TODAY, LLC. Although we provide rules for visitors, members, or reader conduct and postings, we do not control and are not responsible for what visitors, readers or members post, transmit, or share on our Website or Services, and are not responsible for any offensive, inappropriate, obscene, unlawful, or otherwise objectionable content you may encounter using our Website or Services. CONCIERGE MEDICINE TODAY, LLC is not responsible for the online or offline conduct of any User of our Website or Services.

6.5 Our Website or Services may be temporarily unavailable from time to time for maintenance or other reasons. CONCIERGE MEDICINE TODAY, LLC assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, unauthorized access to, or alteration of Member communications.

6.6 CONCIERGE MEDICINE TODAY, LLC is not responsible for any technical malfunction or other problems of any telephone network or service, computer system, server or provider, computer or mobile phone equipment, or software, or for any failure of email on account of technical problems or traffic congestion on the Internet, or for any combination thereof – including injury or damage to Members’ or any other person’s computer, mobile phone, or other hardware or software – related to or resulting from the use or downloading of materials in connection with our Website or Services, including, without limitation, any software provided through our Website or Services.

6.7 Under no circumstances will CONCIERGE MEDICINE TODAY, LLC be responsible for any loss or damage, including any loss or damage, personal injury, or death resulting from anyone’s use of our Website or Services, or any interactions between Users of our Website or Services, whether online or offline. Reference to any products, services, processes, or other information by trade name, trademark, manufacturer, supplier, or otherwise does not constitute or imply endorsement, sponsorship, recommendation, or any affiliation with our Website by third parties or by any of the equipment or programming associated with or utilized by our Services.

6.8 THE INFORMATION, CONTENT, AND DOCUMENTS FROM OR THROUGH OUR WEBSITE ARE PROVIDED ‘AS-IS’, ‘AS AVAILABLE’, WITH ‘ALL FAULTS’, AND ALL EXPRESS OR IMPLIED WARRANTIES ARE DISCLAIMED (INCLUDING, BUT NOT LIMITED TO, THE DISCLAIMER OF ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE). NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, CONCIERGE MEDICINE TODAY, LLC’S LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER, AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US FOR WEBSITE AND/OR SERVICES ACCESSED DURING THE PREVIOUS ONE DAY PRIOR OF YOUR USE of OUR WEB SITE PRIOR TO THE EVENT GIVING RISE TO LIABILITY.

7. Arbitration, Governing law and Jurisdiction

7.1. Any legal controversy or claim arising from or relating to this Agreement and/or our Service, excluding legal action taken by us to collect or recover damages for – or obtain any injunction relating to – website operations, intellectual property, and our Service, will be settled solely by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim will be arbitrated on an individual basis, and will not be consolidated in any arbitration with any claim or controversy of any other party.

7.2 The arbitration will be conducted in Alpharetta, GA, and judgment on the arbitration award may be entered into any court having jurisdiction thereof. You or we may seek any interim or preliminary relief from a court of competent jurisdiction in Alpharetta, GA necessary to protect our or your rights or property pending the completion of arbitration. Each party will bear half the arbitration fees and costs.

7.3 This Agreement will be treated as if it were executed and performed in the State of Georgia, and will be governed by and construed in accordance with the laws of the state of Georgia without regard to conflict of law provisions. In addition, you agree to submit to the personal jurisdiction and venue of such courts. Any cause of action by you with respect to our Website or Service must be instituted within one (1) year after the cause of action arose or be forever waived and barred.

7.4 This Agreement shall be governed by the laws of the State of Georgia and the parties shall submit to the exclusive jurisdiction of the Georgia courts.

7.5 All claims and disputes arising under or relating to this Agreement are to be settled by binding arbitration in the state of Georgia. The arbitration shall be conducted on a confidential basis pursuant to the Commercial Arbitration Rules of the American Arbitration Association. Any decision or award as a result of any such arbitration proceeding shall be in writing and shall provide an explanation for all conclusions of law and fact and shall include the assessment of costs, expenses, and reasonable attorneys’ fees. Any such arbitration shall include a written record of the arbitration hearing. An award of arbitration may be confirmed in a court of competent jurisdiction.

7.6 Limited License – Concierge Medicine Today, LLC grants you a nonexclusive, nontransferable, revocable license to access and use our Website and Services strictly in accordance with this Agreement. Your use of our Website and Services is solely for internal, personal, noncommercial purposes unless otherwise provided for in this Agreement. No printout or electronic version of any part of our Website or Services may be used by you in any litigation or arbitration matter whatsoever under any circumstances.

7.7 Legal Compliance – You agree to comply with all applicable domestic and international laws, statutes, ordinances, and regulations regarding your use of our Website, Content, Services, and any software provided therein.

7.8 Our Relationship To You – This Agreement in no way creates any agency, partnership, joint venture, or employee-employer or franchisor-franchisee relationship between you and Concierge Medicine Today, LLC.

8. Errors, Corrections, and Changes

8.1 We do not represent or otherwise warrant that our Website will be error-free or free from viruses or other harmful components, or that we will correct any errors. We do not represent or otherwise warrant that the information available on or through our Website will be correct, accurate, timely, or otherwise reliable. CMT reserves the right at our sole discretion to change any content, software, and other items used or contained in our Website or Services at any time without notice.

15. Payments

15.1 You represent and warrant that if you are purchasing something from us, (i) any payment information you supply is true and complete, (ii) charges incurred by you will be honored by your bank or credit card company, (iii) you will pay the charges incurred by you at the posted prices, including any applicable taxes, and (iv) if your initial payment method is dishonored, you will still pay the incurred charges, including any surcharge we may incur due to the dishonored payment.

16. Refund and Return Policy On Physical and/or Virtual Products

16.1 PHYSICIAL PRODUCTS (Eg. Books, Socks, such as Physical Materials) We do not offer refunds for ebooks, Kindles, paperback or softcover, hardcover books, third party books, any of our Online, On-Demand Courses, Job Listings, Directory listings, or Subscriptions or Sponsorships.

16.2 Refund and Return Policy For Live and/or Virtual Conferences, Live and/or Virtual Events. The following policy applies to both LIVE, in-person events and Virtual or pre-recorded events.

16.3 The ticket purchaser is given the right to use the ticket for the rescheduled event or to exchange the ticket for a comparable ticket to a similar event.

16.4 If the Concierge Medicine Today, LLC., (herein CMF) CONCIERGE MEDICINE FORUM is prevented from carrying out its obligations to the registrants to conduct its 2021 conference as a result of any issue beyond its control, or the conference cannot be conducted virtually because of availability of speakers, logistics, costs, software or issues with the hosting platform or due to Acts of God, strikes, labor disputes, government requisitions or restrictions or war or apparent act of war, terrorism, disaster, civil disorder, epidemic or pandemic, curtailment or restriction on transportation facilities or any other comparable calamity, casualty or condition making it impossible or impracticable to hold the 2021 conference or any part thereof (each of the foregoing, a “Force Majeure”) , CMF shall have the right to immediately terminate all or any portion of the 2021 conference without liability and shall be relieved of its obligations to all registrants. CMF reserves the sole right to determine if undelivered content can reasonably be delivered by alternative arrangements. If the 2021 CMF conference is terminated due to a Force Majeure occurrence before the first day of the conference, CMF will reschedule a similar all virtual event either through CMF or an affiliate organization and your registration fee will be applied to the rescheduled conference.

16.5 CMF event ticket purchases are transferrable but non-refundable if you are unable to attend.

16.6 We do not apply discounts retroactively. Once you have registered, even if a promo code is found after you registered, your fees will not be adjusted downward based on any sponsorship, promo code, discount or any other reason.

16.7 Virtual tickets are only valid for one user. Registrants failing to attend the event will not be eligible for a refund.

16.8 If your payment is received in currency other than U.S. dollars, and you are due a refund, you will be responsible for any foreign exchange rate difference.

16.9 Concierge Medicine Today, LLC., does not and is not obligated to provide a credit voucher to registered attendee(s) who do not attend any virtual or live event for which they registered for. Therefore, Registrants failing to attend the event will not be eligible for a refund.

16.10 REGISTRATION FEE DEFINITION: The fee includes the conference‚ all program materials‚ and designated continental breakfasts‚ lunches and refreshments.

  1. Request For Change/Refund Request Form – Cancellations received via phone or email will not be accepted. You must submit in writing your Request for Change found here.

16.12 Current Cancellation and Refund Policy

  1. Conference registration cancellation requests submitted on or before September 15, 2021 will be refunded, less a 50% processing fee or a $150 administrative fee per ticket, whichever is less.
  2. Cancellations received on or before September 30, 2021 will be refunded, less a 75% processing fee or a $200 administrative fee per ticket, whichever is less.
  3. No refunds or credits will be issued for conference registration cancellations received after September 30, 2021.
  4. Additionally, in the case the registrant has completed the Request for Change Form found here, tickets purchased will be: 1) refunded and all ticket purchases minus a $150 administrative fee per ticket OR 50% of the total ticket purchases price will be refunded within 15 days of a cancellation; or, 2) Ticket purchaser fees will be Rolled Over to another event; or, 3) Fees will be redirected to other benefits; or, 4) Ticket Fees may be donated to the event organizer.

16.13 Redirecting Registration Fees Purchase and Rollover Options Available

  1. Rollover Registration
    1. If an event gets postponed, moved to a virtual platform or rescheduled to a future date, the tickets will automatically transfer to that future event date.
  2. Credit Vouchers (Expire in 18mos)
    1. Credit vouchers are valid for 18 months from date of issue. Credit vouchers are valid toward one (1) Concierge Medicine Today, LLC event of equal or lesser value. If the full amount of said voucher is not used at time of registration, any remaining balance is not applicable now or in the future. Once a credit voucher has been applied toward a future event, no further changes or edits will be allowed. In the event of cancellation on the attendees’ behalf, the credit voucher will no longer be valid and the money will not be refunded.
  3. Redirecting Fees to Other Benefits
    1. If an event gets postponed, moved to a virtual platform or rescheduled to a future date, the tickets may automatically transfer to our DocPreneur Leadership Academy Courses and/or Classes. We’ll let registrants use redirect their ticket fees on anything we have to offer within the DocPreneur Leadership Academy, whether that’s a membership extension, a Master Class, Course Registration, or another event. What we want to do is to be flexible with everyone and permit them to have a few different options. And if you still don’t want to do that and invest in these other ways, then refund any ticket purchase(s) minus a $150 administrative fee per ticket, will be refunded within 60 days of a cancellation.
  4. MAKE A DONATION
    1. It takes significant expenditures to cancel and/or run an event. Let us know that you’d like to donate your ticket fee to our operations and we will do so. Note, Concierge Medicine Today, LLC., is not a non-profit organization and you will not receive a tax deduction.

16.15 Concierge Medicine Today reserves the right to cancel any event it deems necessary and will not be responsible for airfare‚ hotel or any other expenses incurred by registrants.

16.16 Concierge Medicine Today’s financial liability/obligation to you is limited only to the conference registration fee in the event of a cancellation and does not include changes in program date‚ content‚ speakers and/or venue or any other expenses you may have personally or professionally incurred as a result of attending or participating in said live or virtual event.

16.17 By registering for this event you understand that *The opinions of Concierge Medicine Today’s speakers do not necessarily reflect those of the companies they represent, nor Concierge Medicine Today, and furthermore, hold harmless Concierge Medicine Today, LLC., its affiliated employees, representatives and/or companies or entities and any/all individuals liable for any reason.

16.18 Speakers and agenda are subject to change without notice. In the event of a speaker cancellation, significant effort to find a suitable replacement will be made. The content in Concierge Medicine Today slide presentations, including news, data, advertisements and other information, is provided by Concierge Medicine Today’s designated speakers and is designed for informational purposes for its attendees. It is NOT INTENDED for purposes of copy writing or redistribution to other outlets without the express written permission of Concierge Medicine Today’s designated speaking parties. Neither Concierge Medicine Today nor its content providers and/or speakers and attendees shall be liable for any errors, inaccuracies or delays in content, or for any actions taken in reliance thereon.

16.19 Force Majeure

  1. No refund is required if the event is rescheduled due to an act of God or catastrophe and the ticket purchaser is given the right to use the ticket for the rescheduled event or to exchange the ticket for a comparable ticket to a similar event.

17. Use of Likeness and NOTICE of FILMING, Recording and/or PHOTOGRAPHY

17.1 Use of Likeness – By participating in the 2021 CMF conference, each registrant grants the CMF the right to record, film, livestream, photograph or capture their likeness in any media now available or hereafter developed and to distribute, broadcast, use or otherwise disseminate, in perpetuity, such media without any further approval from the registrant or any payment to the registrant. This grant to CMF includes, but is not limited to, the right to edit such media, the right to use the media alone or together with any other information, and the right to allow others to use or disseminate the media.

17.2 When you enter a Concierge Medicine Today (CMT) FORUM or event, room, breakout session, property outside/parking lot/picnic tables, workshop, reception, party, general session, hallway, lobby, etc., or program, you enter an area where photography, audio, and video recording may occur. By entering the event premises, property, etc., outside or inside the building, wherever people are gathering and/or an event or people is or are happening or hosted, you consent to interview(s), photography, audio recording, video recording and its/their full release, publication, exhibition, or reproduction to be used by Concierge Medicine Today, LLC., and its affiliated representatives or entities for any and all news, web casts, podcasts, webinars, promotional purposes, print media, digital media, telecasts, advertising of any kind, testimonials, inclusion on website(s), social media, or any other purpose by CMT and its affiliates and representatives for life. You may not record audio or video of physical or virtual sessions at any event, session, breakout or gathering, whether informal or formal while on site at the event. Images, photos and/or videos may be used to promote similar related CMT events in the future, highlight event and exhibit the capabilities of CMT and affiliated businesses. You release CMT, its officers and employees, and each and any and all persons involved from any liability connected with the taking, recording, digitizing, or publication and use of interviews, photographs, computer images, video and/or or sound recordings. Furthermore, by entering the event premises, you waive all rights you may have to any claims for payment or royalties in connection with any use, exhibition, streaming, web casting, televising, or other publication of these materials, regardless of the purpose or sponsoring of such use, exhibiting, broadcasting, web casting, or other publication irrespective of whether a fee for admission or sponsorship is charged. You also waive any right to inspect or approve any photo, video, or audio recording taken by CMT or the person or entity designated to do so by CMT. By purchasing a ticket [or otherwise accompanying/entering or being in the vicinity of the event] you have been fully informed of your consent, waiver of liability, and release before entering the event. I hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE (on behalf of myself and my business, etc.) Concierge Medicine Today (CMT), their employees, representatives, an individual private or affiliated with conference in any way, speakers, etc., and employees and/or any contract employees from any liability related to photography, videography, social media posts or digital or print media capture and use of any kind during and after the event which might occur as a result of your being on the physical of virtual premises and/or in any way by participating in the event. I CERTIFY THAT I HAVE READ THIS DOCUMENT, AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I AGREE TO IT OF MY OWN FREE WILL.

18. CONSENT FORM, WAIVER, Acknowledgements and RELEASE of LIABILITY

18.1 I HEREBY ASSUME ALL OF THE RISKS OF PARTICIPATING AND/OR ATTENDING THIS ACTIVITY OR EVENT, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault. I certify that I am physically fit, have sufficiently prepared for participation in the activity or event, and have not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problems which preclude my participation in this activity or event. I acknowledge that this Waiver and Release of Liability Form will be used by the event holders, sponsors, and organizers of the activity or event in which I may participate, and that it will govern my actions and responsibilities at said activity or event. In consideration of me wanting to participate in this event, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows: (A) I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from this event, THE FOLLOWING ENTITIES OR PERSONS: Concierge Medicine Today (CMT) their directors, officers, employees, volunteers, representatives, and agents, the activity or event holders, activity or event sponsors, activity or event volunteers; Furthermore, I INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE Concierge Medicine Today (CMT) the entities or persons mentioned in this paragraph from any and all liabilities or claims made as a result of participation in this activity or event, whether caused by the negligence of release or otherwise. I furthermore acknowledge that CMT and their employees, contract workers, volunteers, directors, officers, representatives, and agents are NOT responsible for the errors, omissions, acts, or failures to act of any party or entity conducting a specific event or activity on behalf of CMT. I acknowledge that this activity or event may involve physical activity, and may carry with it the potential for death, serious injury, and property loss. I hereby consent to receive medical treatment which may be deemed advisable in the event of injury, accident, and/or illness during this activity or event. I understand that at this event or related activities, I may be photographed. I agree to allow my photo, video, or film likeness to be used for any purpose by the event holders, producers, sponsors, organizers, and assigns. The accident waiver and release of liability shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.

18.2 By participating, registering, speaking, sponsoring, and/or attending and being in or outside the building near the event, etc., you are acknowledging that an inherent risk of exposure to COVID-19 or other health risk(s) exists in any public place where people are present. By attending the CMT FORUM you and any guests voluntarily assume all risks related to exposure to COVID-19 and any other health risk(s) and agree not to hold Concierge Medicine Today, LLC., or any of their affiliates, directors, officers, employees, agents.

18.3 By using our site, speaking at one of our events, participating in any way at a Concierge Medicine Today, LLC. represented offline, online, course, live event, online event, webinar, podcasts, speaker session, etc., you consent to and agree to our online privacy policy, acceptance of use, legal disclaimers, updated terms and conditions as outlined here https://conciergemedicineforum.com/virtual-sponsor-terms-and-conditions/.

19. Code of Conduct, COVID and Liability Waiver and Release of Claims

19.1 By participating, registering, speaking, sponsoring, and/or attending and being in or outside the building near the event, etc., you are acknowledging that an inherent risk of exposure to COVID-19 or other health risk(s) exists in any public place where people are present. By attending the CMT FORUM you and any guests voluntarily assume all risks related to exposure to COVID-19 and any other health risk(s) and agree not to hold Concierge Medicine Today, LLC., or any of their affiliates, directors, officers, employees, agents, contractors, or volunteers liable for any illness or injury.

19.2 If you do not feel well or are experiencing any symptoms of COVID-19, please do not attend.

19.3 Upon entering the event venue, attendees may be asked to scan a QR code that will take them to a questionnaire to mark their attendance, answer screening questions, and have their temperatures taken. Temperatures may be taken by a masked volunteer or employee or representative. If an in-person event attendee has a temperature of 100.4 or greater they will NOT be permitted in the event venue.

19.3 There may be multiple sanitation stations located throughout the venue. If required, please follow all social distancing guidelines including, remaining 6 ft. apart and refrain from shaking hands. “Any person entering the premises waives all civil liability against this premises owner and operator for any injuries caused by the inherent risk associated with contracting COVID-19 at public gatherings, except for gross negligence, willful and wanton misconduct, reckless infliction of harm, or intentional infliction of harm, by the individual or entity of the premises.”

19.4 You understand that seating may or may not be spaced out to comply with the most up to date social distancing guidelines. You understand that you may be required to comply or asked to leave, thereby forefitting your conference pass and understand that no refund will be given. You may or may not be asked to please wear a mask out of respect for guests, colleagues and/or team members. Masks may be provided for your use if you so ask at the Registration Desk.

19.5 By registering to attend this event, I understand the hazards and risks of attending this event in-person and the risks of COVD-19 and other health ailments. I am familiar with the CDC guidelines regarding COVID-19. I acknowledge and understand that the circumstances regarding COVID-19 are changing from day to day and the CDC guidelines are regularly modified and updated. I accept full responsibility for familiarizing myself with the most recent updates.

19.6 I acknowledge and fully assume the risk of illness or death related to COVID-19 arising from my being on the premises and participating in the event in-person.

19.7 I hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE (on behalf of myself and my business, etc.) Concierge Medicine Today (CMT), their employees, representatives, speakers, etc., and their employees and the Forsyth Conference Center and their employees from any liability related to COVID-19 which might occur as a result of my being on the premises and participating in the event.

19.7 I understand the guidelines which CMT has set in place, and I agree to uphold these guidelines to help keep myself and other attendees safe. If I choose not to uphold these guidelines, I understand that I could be asked to leave the event and will not receive a refund.

19.8 By registering, attending, participating, speaking, sponsoring, etc., I acknowledge fully the risk(s) I am taking and yes, I have read and fully understand the risks associated with attending in-person events. And, I agree to not hold CMT and its employees, representatives or the Forsyth Conference Center and its employees liable for any illness or harm that could arise from participating in this event in-person. I will abide by all guidelines CMT and The Forsyth Conference Center have set in place. “Any person entering the premises waives all civil liability against this premises owner and operator for any injuries caused by the inherent risk associated with contracting COVID-19 at public gatherings, except for gross negligence, willful and wanton misconduct, reckless infliction of harm, or intentional infliction of harm, by the individual or entity of the premises.”

19.9 COVID-19 Safety Acknowledgment — Liability Waiver and Release of Claims COVID-19 SAFETY INFORMATION:

By registering and attending, participating or sponsoring at at CMT Event, it is inherently applied that you have read, understand and all parties in your group, organization, company, practice, party, etc., agree to our COVID-19 Safety Acknowledgment Liability Waiver and Release of Claims Terms & Conditions As Outlined Below:

I Understand that EACH INDIVIDUAL IN MY PARTY, organization, company, etc., MUST ABIDE BY AND IS UNDER THE SAME AGREEMENT AS OUTLINED HERE. Entry Is Not Permitted Until Confirmation of Acceptance of Terms Is Received & Shown/Verified By Our Guest Services Team at the Registration Table. Thank you for your understanding and patience.

While participating in events held or sponsored by Concierge Medicine Today, LLC., (“CMT”), consistent with CDC guidelines, participants are encouraged to practice hand hygiene, “social distancing” and wear face coverings to reduce the risks of exposure to COVID-19. Because COVID-19 is extremely contagious and is spread mainly from person-to-person contact, CMT has put in place preventative measures to reduce the spread of COVID-19. However, CMT cannot guarantee that its participants, volunteers, partners, or others in attendance will not become infected with COVID-19. In light of the ongoing spread of COVID-19, individuals who fall within any of the categories below should not engage in CMT events and/or other face to face fundraising activities.

By attending an CMT event, you certify that you do not fall into any of the following categories:

1. Individuals who currently or within the past fourteen (14) days have experienced any symptoms associated with COVID-19, which include fever, cough, and shortness of breath among others;

2. Individuals who have traveled at any point in the past fourteen (14) days either internationally or to a community in the U.S. that has experienced or is experiencing sustained community spread of COVID-19; or

3. Individuals who believe that they may have been exposed to a confirmed or suspected case of COVID-19 or have been diagnosed with COVID-19 and are not yet cleared as non-contagious by state or local public health authorities or the health care team responsible for their treatment.

DUTY TO SELF-MONITOR:

Participants and volunteers agree to self-monitor for signs and symptoms of COVID-19 (symptoms typically include fever, cough, and shortness of breath).

LIABILITY WAIVER AND RELEASE OF CLAIMS:

I acknowledge that I derive personal satisfaction and a benefit by virtue of my participation and/or voluntarism with CMT, and I willingly engage in CMT events and/or other activities (the “Activity”).

RELEASE AND WAIVER.

I HEREBY RELEASE, WAIVE AND FOREVER DISCHARGE ANY AND ALL LIABILITY, CLAIMS, AND DEMANDS OF WHATEVER KIND OR NATURE AGAINST THE CONCIERGE MEDICINE TODAY, LLC. AND ITS AFFILIATED PARTNERS, CONTRACTORS, SPEAKERS, VOLUNTEERS AND SPONSORS, INCLUDING IN EACH CASE, WITHOUT LIMITATION, THEIR DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, AND AGENTS (THE “RELEASED PARTIES”), EITHER IN LAW OR IN EQUITY, TO THE FULLEST EXTENT PERMISSIBLE BY LAW, INCLUDING BUT NOT LIMITED TO DAMAGES OR LOSSES CAUSED BY THE NEGLIGENCE, FAULT OR CONDUCT OF ANY KIND ON THE PART OF THE RELEASED PARTIES, INCLUDING BUT NOT LIMITED TO DEATH, BODILY INJURY, ILLNESS, ECONOMIC LOSS OR OUT OF POCKET EXPENSES, OR LOSS OR DAMAGE TO PROPERTY, WHICH I, MY HEIRS, ASSIGNEES, NEXT OF KIN AND/OR LEGALLY APPOINTED OR DESIGNATED REPRESENTATIVES, MAY HAVE OR WHICH MAY HEREINAFTER ACCRUE ON MY BEHALF, WHICH ARISE OR MAY HEREAFTER ARISE FROM MY PARTICIPATION WITH THE ACTIVITY.

ASSUMPTION OF THE RISK.

I acknowledge and understand the following:

1. Participation includes possible exposure to and illness from infectious diseases including but not limited to COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist;

2. I knowingly and freely assume all such risks related to illness and infectious diseases, such as COVID-19, even if arising from the negligence or fault of the Released Parties; and

3. I hereby knowingly assume the risk of injury, harm and loss associated with the Activity, including any injury, harm and loss caused by the negligence, fault or conduct of any kind on the part of the Released Parties.

MEDICAL ACKNOWLEDGMENT AND RELEASE.

I acknowledge the health risks associated with the Activity, including but not limited to transient dizziness, lightheaded, fainting, nausea, muscle cramping, musculoskeletal injury, joint pains, sprains and strains, heart attack, stroke, or sudden death. I agree that if I experience any of these or any other symptoms during the Activity, I will discontinue my participation immediately and seek appropriate medical attention.

I DO HEREBY RELEASE AND FOREVER DISCHARGE THE RELEASED PARTIES FROM ANY CLAIM WHATSOEVER WHICH ARISES OR MAY HEREAFTER ARISE ON ACCOUNT OF ANY FIRST AID, TREATMENT, OR SERVICE RENDERED IN CONNECTION WITH MY PARTICIPATION IN THE ACTIVITY.

As a participant, volunteer, or attendee, sponsor, speaker, etc., You recognize that your participation, involvement and/or attendance at any Concierge Medicine Today, LLC. event or activity (“Activity”) is voluntary and may result in personal injury (including death) and/or property damage.

By attending, observing or participating in the Activity, You acknowledge and assume all risks and dangers associated with your participation and/or attendance at the Activity, and You agree that: (a) the Concierge Medicine Today, LLC. (b) the property or site owner of the Activity, and (c) all past, present and future affiliates, successors, assigns, employees, volunteers, vendors, partners, directors, and officers, of such entities (subsections (a) through (c), collectively, the “Released Parties”), will not be responsible for any personal injury (including death), property damage, or other loss suffered as a result of your participation in, attendance at, and/or observation of the Activity, regardless if any such injuries or losses are caused by the negligence of any of the Released Parties (collectively, the “Released Claims”).

BY ATTENDING AND/OR PARTICIPATING IN THE ACTIVITY, YOU ARE DEEMED TO HAVE GIVEN A FULL RELEASE OF LIABILITY TO THE RELEASED PARTIES TO THE FULLEST EXTENT PERMITTED BY LAW confirmed prior to the commencement of the event. Concierge Medicine Today reserves the right to cancel any event it deems necessary and will not be responsible for airfare‚ hotel or any other expenses incurred by registrants.

19.11 By registering for a Concierge Medicine Today, LLC. (“CMT”) event, you also agree to the following set of terms and conditions listed below:

  1. Before Leaving Home
    1. Follow relevant guidance provided by the World Health Organization (WHO), CDC, or your local health authority.
    2. Adhere to government issued travel restrictions and guidance issued by the region you will be travelling to and the region you are travelling from.
    3. Evaluate your own health and that of people you are in close contact with; contact the meeting/event organizers if you have concerns.
    4. Do not attend the Event if you have experienced any of the following symptoms in the 14 days leading up to the Event: fever, sore throat, symptoms of acute respiratory illness, flu-like symptoms, loss of taste or smell, chills, fatigue, difficulty breathing or dry cough.
  2. On-site, During the Event
    1. If at any time during the Event you begin experiencing symptoms of COVID-19 or discover you have been exposed to COVID-19, you should immediately discontinue further participation in the Event.
    2. Follow guidance from the local health authority where the event is being held for everyday preventive actions to help prevent the spread of respiratory viruses.
    3. Abide by on-site guidelines that are publicized once at event venue, as they may change slightly from what was originally published, based on the local and venue requirements and guidance at time of event.
  3. Post-event
    1. Based on current contact tracing advice from many health authorities, if you test positive for COVID-19 up to 14 days after returning home, please contact the meeting/event organizers to advise them.
    2. This information should not be considered medical or legal advice and is not intended to supersede applicable governmental regulations and guidance.
    3. Due to the fast-evolving nature of COVID-19 science and recommended best practices, the information in this document may become outdated quickly and is subject to change at any time. I acknowledge that COVID-19 is an extremely contagious virus that spreads easily through person-to-person contact and can lead to severe illness and death.
    4. As with any social activity, participation in this event and/or Concierge Medicine Today, LLC (collectively, the “Parties”) Conference could present the risk of contracting COVID-19. According to the Centers for Disease Control and Prevention, senior citizens and guests with underlying medical conditions are especially vulnerable. The Parties can in no way warrant that COVID-19 infection will not occur through participation in the Conference(s) and by attending you voluntarily assume all risks related to COVID-10 exposure; agree to abide by the then-current Conference COVID Code of Conduct issued by the Parties; and you agree to indemnify and hold harmless the Parties from any and all COVID-19 liabilities or claims. Conference registration cancellation requests submitted on or before September 15, 2021 will be refunded, less a $150 administrative fee per ticket. No refunds or credits will be issued for conference registration cancellations received after September 30, 2021.

20. Indemnification

20.1 You agree to indemnify, defend, and hold us and our partners, agents, officers, directors, employees, subcontractors, successors, assigns, third-party suppliers of information and documents, attorneys, advertisers, product and service providers, and affiliates free from any liability, loss, claim, and expense, including reasonable attorney’s fees, related to your violation of this Agreement or use of our Website or Services.

21. Severability and Survival

21.1 Should any part of this Agreement be held invalid or unenforceable, that portion will be construed consistent with applicable law and the remaining portions will remain in full force and effect. To the extent that any Content is in conflict or inconsistent with this Agreement, this Agreement will take precedence. Our failure to enforce any provision of this Agreement will not be deemed a waiver of such a provision, nor of the right to enforce such a provision. Our rights under this Agreement will survive any termination of this Agreement.

22. Changes to Our Terms and Conditions

22.1 We reserve the right to change these Terms and Conditions at any time without giving you advance notice of the changes by email or in writing. We will also post these changes on our website. These changes will become effective immediately. Your continued use of our Website, Services, and Products after any update or change to these Terms and Conditions and our posting of these updated Terms and Conditions to any one of our sites will constitute your acceptance of and agreement to such change. If you do not agree with the changes to these Terms and Conditions, you can choose to discontinue the use of our Website, Services, and Products.
